On Wednesday, 22 November 2023, a complaint was filed against the actor accusing him of sexually assaulting a woman in a New York bar in 2015.
Complaint filed against Jamie Foxx
The alleged victim, identified in the complaint as Jane Doe - a generic name to protect her identity - claims that Jamie Foxx took her to a secluded corner of Catch NYC (the name of the bar) where he allegedly touched her breast and slipped his hand under her pants against her will.
According to the complaint, reported by Variety, the woman and a friend were seated at a table next to Jamie Foxx and Mark Birnbaum, the owner of the premises. At around 1 a.m., the complainant's friend allegedly got up to ask the actor for a photo - a request accepted by Jamie Foxx.
Then, he reportedly began complimenting the complainant, saying she had 'a super model's body' and 'smelled great', even comparing her to Gabrielle Union. Jamie Foxx then allegedly pulled her by the arm to a more secluded area, where he committed the assault.

A direct witness to the scene
The complainant states that she was caught off guard and tried to move away, but Jamie Foxx then allegedly put his hands down her pants. The complaint mentions the presence of a security guard, who witnessed the scene but did not intervene. The victim's friend then arrived, and Jamie Foxx allegedly stopped his behaviour and walked away.
The alleged victim is seeking damages for pain, suffering, emotional distress, anxiety and humiliation. The complaint states that the victim suffered pain and had to seek medical treatment following the assault.
In addition to Jamie Foxx, the complaint also names the bar owner and staff (including the security guard), accusing them of facilitating the assault and failing to properly supervise their employees.

What does Jamie Foxx have to say?
Jamie Foxx's entourage has yet to comment on the allegations, as we also don't know whether the actor has been released from the hospital. This case is part of New York's Adult Survivors Act, which extends by one year the time limit for filing complaints of sexual abuse.
